2. Applicability
These terms and conditions apply to all offers, orders, and agreements made through the Switch It Up! online store at switchitup.shop. By placing an order, you agree to these terms. We may refuse orders at our discretion without stating a reason.
3. Products & Pricing
All prices are listed in euros (EUR) and include VAT where applicable. We reserve the right to adjust prices at any time. The prices shown at the time of your order are final for that order.
Product images and descriptions are as accurate as possible but may vary slightly due to screen colour differences, photography, or minor production variations. Such variations do not constitute a defect and are not grounds for return outside the normal withdrawal period.
4. Orders & Contract Formation
A binding contract is formed when we send the order confirmation email. Until that moment, we may decline or cancel an order — for example, in case of pricing errors, suspected fraud, or stock unavailability. If we cancel an order for which payment has already been received, we will refund the full amount without delay.
We accept payments through iDEAL, credit card, and other methods available at checkout via our payment provider Mollie.
5. Shipping
We ship to all EU countries. Delivery times are estimates and may vary. You will receive a tracking number once your order has been shipped. Delivery times are not binding deadlines; late delivery alone does not entitle you to cancel unless a reasonable additional period has passed.
6. Right of Withdrawal
Under EU consumer law, you have the right to cancel your order within 14 days of receiving your goods, without giving any reason. To exercise this right, you must inform us by email before the 14-day period expires. You then have another 14 days to return the goods. 7. Liability
Our liability is limited to what is permitted under Dutch law. In particular:
- We are not liable for indirect or consequential damages, including but not limited to lost profits, data loss, or business interruption.
- Our total liability for any claim shall not exceed the purchase price of the product(s) in question.
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Dutch law.
8. Force Majeure
We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, supplier failures, carrier disruptions, government actions, or infrastructure outages. In such cases, we may extend delivery times or cancel orders with a full refund.
9. Abuse & Fraud
We reserve the right to refuse, cancel, or limit orders in cases of suspected abuse or fraud, including but not limited to: systematically excessive returns, fraudulent payment disputes (chargebacks), orders placed in bad faith, or any pattern of behaviour intended to exploit our services. This does not affect your statutory consumer rights.
10. Intellectual Property
All content on this website — including designs, logos, images, and text — is the property of Switch It Up! or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or commercially use any content without our prior written consent.
11. Privacy
We process your personal data in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR).
12. Dispute Resolution
If you have a complaint, please contact us first at info@switchitup.shop so we can try to resolve it directly.
The European Commission provides a consumer redress portal at: https://consumer-redress.ec.europa.eu/. You may use this platform to submit a complaint about an online purchase.
13. Applicable Law
These terms are governed by Dutch law. Any disputes that cannot be resolved amicably will be submitted to the competent court in the Netherlands. This choice of law does not deprive you of the protection of mandatory consumer law provisions of your country of residence.
